In February and March of 1996, Pamela Jean Tylka, H. Joshua Chaet, Cheryl Keller, Jeanette DeLeon, Toni Cainkar, Elaine T. Hyneck, and Barbara F. Berg filed almost identical class-action lawsuits against Gerber Products in the Circuit Court of Cook County, Illinois. In their complaints, the plaintiffs alleged that Gerber engaged in a pattern of false and deceptive advertising concerning the nutritional value and content of its baby food products, in violation of the Illinois Consumer Fraud and Deceptive Business Practices Act, 815 Ill. Comp. Stats. 505/1, the Uniform Deceptive Trade Practices Act, 815 Ill. Comp. Stats. 510/1, and Illinois common law fraud. Pursuant to 28 U.S.C. sec. 1446, Gerber removed these cases to the United States District Court for the Northern District of Illinois, alleging that diversity jurisdiction existed.
